Terms and Conditions

These Terms and Conditions ("Agreement") govern the purchase and use of the WizLand Starter CMS software product ("Product") by individual users and organizations. By purchasing and using the Product, you agree to comply with and be bound by the following terms.

1. Definitions

• "Company": WizLand, the provider and licensor of the Product.
• "Customer": The individual or organization purchasing a license to use the Product.
• "Product": The WizLand Starter CMS Boilerplate, including source code, documentation, and future updates.
• "License": The non-exclusive right to use the Product under the conditions specified in this Agreement.

2. License Terms

• The Product is sold under a one-time lifetime license model.
• The license is non-exclusive, non-transferable, and grants the Customer rights to:
  • Use the Product for unlimited projects.
  • Modify the source code for internal or client use.
  • Receive lifetime access to updates as per the selected plan tier (Pro or Team).
• The Customer may not:
  • Resell, redistribute, or sublicense the Product or its code.
  • Share access credentials or the product source code with unauthorized users.

3. Pricing & Payment

• Lifetime plans are charged once, based on the selected tier (e.g., Pro or Team).
• Prices are displayed in USD and are exclusive of taxes unless otherwise noted.
• Payment is collected securely via supported third-party processors.
• All payments are non-refundable, unless required by law or stated otherwise in this Agreement.

4. Updates & Support

• Customers will receive updates to the Product (features, bug fixes, improvements) as long as the Product remains under active development.
• Pro Plan: Includes community support via forums or email.
• Team Plan: Includes priority support and access to private channels (e.g., Discord).
• The Company does not guarantee response times, but will endeavor to assist Customers within 48 hours on business days.

5. Intellectual Property

• All rights, title, and interest in the Product remain with the Company.
• The license grants usage rights only — it does not imply transfer of ownership.

6. Use Restrictions

The Customer agrees not to:

• Use the Product for any unlawful purposes.
• Misrepresent the Product as their own public project or starter template.
• Distribute the Product, in full or in part, on platforms such as GitHub, marketplaces, or commercial templates.

7. Termination

• This license remains valid for the life of the Product or until terminated.
• The Company may revoke the license if the Customer breaches this Agreement, especially around misuse, redistribution, or payment fraud.
• Upon termination, the Customer must cease use and delete all copies of the Product.

8. No Warranty

• The Product is provided "as is", without warranties of any kind, express or implied.
• The Company does not guarantee that the Product will be error-free or meet all project-specific needs.

9. Limitation of Liability

• The Company's liability is limited to the purchase amount paid for the Product.
• The Company is not liable for any indirect or consequential damages, such as lost profits or data loss.

10. Amendments

The Company reserves the right to update these Terms from time to time. Changes will be posted on the official website. Continued use of the Product after changes indicates acceptance.

12. No Refund & No Resell Policy

• All sales of WizLand Starter lifetime licenses are final and non-refundable.
• Customers may not resell, redistribute, sublicense, or otherwise commercialize the Product or any part of its source code.
• The license grants use of the CMS structure and boilerplate only.
• Third-party components such as Strapi, Tailwind CSS, Shadcn UI, and others are open source and licensed separately under their respective licenses (e.g., MIT). WizLand Starter includes these components as part of the Product but does not claim ownership or sell these third-party libraries themselves.

13. Copyright & Open Source Licenses

• WizLand Starter bundles and configures popular open-source projects including:

  • Strapi (licensed under GNU AGPL v3)
  • Tailwind CSS (licensed under MIT License)
  • Shadcn UI / Radix UI (licensed under MIT License)

• Customers must comply with the licenses of these third-party components when using the Product.

14. Piracy Warning

We have received reports of pirated or unauthorized copies of WizLand Starter being sold or used.

• If you or anyone you know is selling or using pirated versions of WizLand Starter:

  • Your license will be revoked immediately with no refunds.
  • We reserve the right to inform your employer or organization about your unauthorized use.
  • We will pursue legal action, including cease and desist orders, to the fullest extent permitted by law.

• If you cannot afford WizLand Starter, please use free and official open-source alternatives directly from their respective projects such as Strapi, Tailwind CSS, and Shadcn UI.

• Note that pirated copies often contain malware or malicious code that can compromise your data and privacy.
